Terms for Click Photo Booth Hire and Event Services.

These Terms of Service explain how enquiries, bookings, payments, cancellations, venue access, event operation, media delivery, data handling and liability work when you book Click Photo Booth. They are designed to be read alongside your event proposal or quote and, where issued, your Booking Agreement.

Clear terms before the event. Your event-specific proposal records the package, date, operating time, price, inclusions and any agreed extras. These general terms explain the rules that sit behind it.
Event-specific proposalThe confirmed proposal takes priority for package-specific details.

An enquiry is not a booking.

Your date is confirmed only after the required booking steps have been completed and we confirm the booking in writing.

Final balance: 30 days before.

Unless your proposal says otherwise, the outstanding balance must be cleared at least 30 days before the event.

Venue access matters.

You must provide suitable space, power, access and enough setup time for the confirmed booth configuration.

Marketing use needs permission.

Guest or client media is not treated as approved for promotional use merely because nobody opted out.

Connectivity can affect sharing.

Instant sharing depends on suitable connectivity. Capture can continue even where live delivery is temporarily unavailable.

Package limits still apply.

Print allowances, hire length, backdrops, add-ons and reporting are governed by the package and proposal you actually book.

Contract documents and order of priority

Your agreement may consist of these Terms of Service, the event proposal or quotation, any Booking Agreement, any confirmed change agreed in writing and the Privacy Policy where personal information is involved.

If an event-specific proposal or Booking Agreement contains a term that differs from these general terms, the event-specific wording will normally take priority for that booking. Nothing in any document overrides rights or responsibilities that cannot lawfully be excluded.

Enquiries, proposals and when a booking is confirmed

Submitting an enquiry, availability form or proposal request does not reserve a date and does not create a confirmed booking.

A booking is confirmed only when the required booking steps stated in your proposal have been completed and we issue written confirmation. This will normally include acceptance of the proposal or Booking Agreement and receipt of the required booking payment.

Any date discussed before written confirmation remains subject to availability unless we expressly agree a temporary hold in writing.

Prices, booking payments and final balance

The price for your event is the price shown in the confirmed proposal or Booking Agreement, including any agreed travel, add-ons or venue-specific costs.

  • A booking payment may be required to secure the agreed event date.
  • The booking payment forms part of the overall contract price unless expressly stated otherwise.
  • Unless your proposal states another deadline, the remaining balance is due at least 30 days before the event.
  • Any additional service requested after booking is subject to availability and may increase the total price.

If a payment becomes overdue, we will contact you and may suspend preparation or, after reasonable notice, treat the booking as cancelled where payment remains outstanding.

Consumer cancellation rights

If you are booking as a consumer, you retain all statutory rights that apply to your contract.

Certain contracts for services related to leisure activities on a specific date or during a specific period may fall within an exception to the standard distance-contract cancellation right. Whether that exception applies depends on the nature of the booking and the law in force at the time.

Nothing in these terms removes a statutory cancellation or refund right where the law gives you one.

Cancellation by the client

If you need to cancel, tell us in writing as soon as possible. This gives us a reasonable opportunity to reduce the loss caused by the cancellation, including by re-booking the date where possible.

Any amount retained or charged following cancellation will be limited to a reasonable amount reflecting losses and costs caused by the cancellation, taking account of costs avoided and our ability to mitigate the loss. We do not treat a cancellation charge as automatically fair merely because it appears in a contract.

Where you have paid more than the amount we are reasonably entitled to retain, the appropriate balance will be returned.

Postponements and changes of date

Tell us as early as possible if the event is postponed. We will check the replacement date against existing bookings and make reasonable efforts to transfer the service where practical.

A date transfer is not confirmed until we approve it in writing. Changes in venue, travel distance, hire duration, package pricing or supplier costs may change the price, but any additional charge will be explained before the revised booking is agreed.

If we cannot accommodate the replacement date, the original booking will be dealt with under the cancellation provisions and applicable law.

Cancellation, non-performance or disruption by us

If illness, equipment failure or another serious problem threatens the service, we may use suitable replacement equipment, personnel or an equivalent practical solution where this can be done safely and without materially changing the agreed service.

If we are unable to provide a material part of the contracted service and no reasonable replacement or agreed reschedule is possible, we will provide any refund or price reduction required by law for the service not supplied.

Events outside reasonable control

Neither party is responsible for failing to perform an obligation where performance is prevented by circumstances genuinely outside reasonable control, such as a venue closure, serious transport disruption, dangerous weather, widespread power failure or emergency restrictions.

Both parties should take reasonable steps to reduce the impact. Where the event cannot proceed, we will discuss rescheduling and any refund position in light of services already performed, costs reasonably incurred and applicable consumer law.

Venue, access, space and power requirements

You are responsible for making sure the venue permits the booked service and that we receive accurate access information.

  • Provide a flat, stable and safe booth location suitable for the confirmed setup.
  • Where a booth and backdrop are used, approximately 3m × 3m is a useful planning guide unless another requirement is agreed.
  • Provide access to a suitable standard 13A power socket close to the setup area, normally within around five metres unless otherwise agreed.
  • Provide loading, parking, lift, stair, security and supplier-access information in advance.
  • Allow the agreed setup window. A typical setup may require approximately 60–90 minutes before the operating period begins.
  • Tell us about venue paperwork, induction, insurance, PAT, risk-assessment or method-statement requirements before the deadline imposed by the venue.
Public Liability Insurance: Click Photobooth Ltd maintains Public Liability Insurance for its event operations. Where a venue requests evidence, a copy of the currently published certificate is available below. If a newer certificate has been issued, we may provide the replacement certificate instead.

Additional costs caused by undisclosed access restrictions or venue requirements will only be charged where they are reasonable and have been explained.

Operating times, delays and extensions

The operating period is the time stated in the confirmed proposal. Setup and takedown are separate from the guest-facing hire period unless expressly stated otherwise.

If the booth cannot start on time because the venue, client or another supplier delays access or prevents operation, the scheduled finish time will normally remain unchanged. We will extend the service only where our schedule, staffing and venue access allow it, and any additional hire charge must be agreed.

If a delay is caused by us, we will take reasonable steps to restore the lost service time or provide an appropriate remedy where required.

Digital sharing, internet access and live galleries

Instant sharing features depend on the booth configuration, mobile device compatibility and suitable internet connectivity at the venue.

If connectivity is unavailable or unreliable, photo capture can usually continue, but live delivery, text, email, QR or gallery functions may be delayed until a connection is available. Loss of venue Wi-Fi or mobile signal is not by itself a failure of the photography service where the media is still captured and subsequently delivered.

Any live gallery, branded gallery or reporting feature is included only where the confirmed package or proposal states that it is included.

Printed photographs and package output

Prints are supplied only where they are included in the booked package or added to the proposal. Any print allowance shown in the proposal is the agreed event allowance.

We will take reasonable care to maintain print quality and equipment operation. Where a technical fault materially reduces the agreed printed output, we will use reasonable efforts to restore printing and will provide an appropriate remedy where required by law.

Digital captures, GIFs, Boomerangs, video messages, analytics, surveys, USB delivery, guestbooks, scrapbooks, photo books and other outputs are governed by the specific package or written proposal. They are not included merely because they appear elsewhere on the website.

Guest behaviour, safety and suspension of service

We may pause or stop operation where continuing would create a genuine safety risk to guests, venue staff, our team or equipment.

Where practical, we will first ask the client, organiser or venue to help resolve the issue. Immediate suspension may be necessary where there is violence, threatening behaviour, serious intoxication, deliberate equipment interference or another urgent risk.

If service time is lost because of unsafe guest behaviour or a venue instruction not caused by us, that lost time may not be refundable. This does not affect remedies where the interruption was our responsibility.

Damage to equipment, props and backdrops

Normal wear and tear is our responsibility. You may be responsible for reasonable repair or replacement costs where you, or a guest for whom you are responsible, causes deliberate, reckless or negligent damage to the booth, printer, lighting, props, backdrop or other equipment.

We will provide reasonable evidence of the damage and cost before seeking payment. We will not charge for pre-existing faults or ordinary deterioration through normal use.

Guests, children and event supervision

The client or event organiser remains responsible for general event supervision and for ensuring that children are appropriately supervised by a responsible adult.

Guests should be made aware that photography or video capture is taking place. We process event media and personal information in accordance with our Privacy Policy and any event-specific data arrangement.

Where a school, charity, company or other organisation has its own consent or safeguarding process, it is responsible for telling us about relevant restrictions before the event.

Client-supplied artwork, wording and design approvals

If you supply logos, names, dates, campaign assets, artwork or other content, you confirm that you have the right to use it and to authorise us to use it for the booked event.

You are responsible for checking the accuracy of spelling, dates, names, logos and approved designs before final production. We will correct an error caused by us where reasonably possible. Changes requested after final approval or after production begins may be subject to availability and additional cost.

Corporate clients should supply brand guidelines and approval contacts early enough to meet the agreed design deadline.

Intellectual property and use of supplied assets

You retain ownership of intellectual property that you supply to us, such as logos or original artwork. You grant us a limited licence to use those materials as necessary to prepare and deliver the booked service.

Unless otherwise agreed in writing, Click Photobooth Ltd retains ownership of its original templates, layouts, design systems, software configuration, workflows and other pre-existing creative materials.

The client receives the right to use delivered event media for the purpose reasonably expected from the booking. Any broader commercial licensing requirement should be agreed in writing, particularly for corporate campaigns, paid advertising or third-party brand use.

Event media, marketing use and personal information

We create and process event photographs, GIFs, Boomerangs, videos and associated booking information to provide the contracted service and for the other purposes described in our Privacy Policy.

We do not treat silence or failure to opt out as automatic permission to use identifiable guest media for our own advertising. Where promotional or portfolio use requires consent or another lawful basis, we will handle that separately and appropriately.

For corporate activations that collect email addresses, telephone numbers, survey answers or other personal data, the proposal should identify the intended data flow and any organiser instructions. Roles and responsibilities may need to be agreed separately where the client determines the purposes of the data capture.

Our responsibility and liability

We will perform the service with reasonable care and skill and will provide the service materially in accordance with the confirmed booking.

Consumer bookings

Nothing in these terms excludes or restricts consumer rights or remedies that cannot lawfully be excluded. We do not exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude.

Where the law allows liability to be limited, we are responsible for losses that are a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for losses that are not reasonably foreseeable or that arise from information, access, venue failures or other matters outside our reasonable control.

Business bookings

For clients contracting wholly in the course of business, and subject to liabilities that cannot lawfully be limited, any contractual limitation or cap stated in the event proposal or Booking Agreement will apply. In the absence of a specific agreed cap, neither party is liable for indirect or consequential business loss that was not reasonably foreseeable when the contract was made.

Complaints and resolving problems

If something goes wrong, tell the attendant during the event where possible so we have an opportunity to correct it immediately.

After the event, send any complaint to s.hipkiss@clickphotobooth.co.uk with the event date, client name and a clear description of the issue. We will investigate and respond within a reasonable time.

Nothing in this section prevents a consumer from exercising statutory rights or obtaining independent advice.

Governing law and courts

These terms and the contract are governed by the laws of England and Wales.

If you are a consumer, this does not remove any mandatory legal protections or rights to bring proceedings in another part of the United Kingdom that apply to you by law. Business clients agree that the courts of England and Wales will have jurisdiction unless another arrangement is agreed in writing.

Changes to these terms

We may update these website terms from time to time. The version that applies to a confirmed booking is normally the version provided or available when that booking was made, together with any later change expressly agreed in writing.

We will not use a later website update to remove an accrued statutory right or retrospectively impose a materially more onerous term on an existing consumer booking.
